Abstract
本稿では、2001年の企業年金改革以来、企業年金体系が大きく変貌する中での企業年金法制の課題について論述する。まず、社会保障法など関連諸分野の中での企業年金法制の位置づけについて言及した後、企業年金法制の中核である受給権保護についてわが国企業年金法制上の特色を述べる。次に、2001年企業年金改革の内容と意義について振り返った上で、改革開始後7年が経過した現段階における企業年金体系の大幅な変化と、適格退職年金・厚生年金基金・確定給付企業年金・確定拠出年金の各制度における変化を整理する。その上で、わが国の企業年金法制のあり方について、拡大する財政リスクへの対応、わが国企業年金の二つの面である退職金と老後保障との関係、公私年金の関係という３つの切り口から、その課題と方向性について整理をおこなう。
