Abstract
This article examines the Wunsiedel decision in 2009 by the German Federal Constitutional Court. In this decision, the Court held that Article 130（4）of the Criminal Code does not violate freedom of expression as it is protected by Article 5 of the Basic Law. Article 130（4）of the Code provides the legal basis for prohibiting neo-Nazi’s assembly. Therefore, the decision is important for the fight against neo-Nazism. On the other hand, the decision changes the doctrine of freedom of expression. In this decision, although Article 130（4）of the Code does not fulfill written grounds for the justification of an interference with freedom of expression, the Court recognized Article 130（4） of the Code was compatible with Article 5 of the Basic Law even though it was not a general law. The Court said Article 130（4）of the Code was an inherent exception to the general law requirement due to the historical dimension of injustice by Nazis. The main question of this paper is why the Court regards Article 130（4）of the Code as not a general law and how non-general law survives under a strict test of proportionality.
