Abstract
Interim royalty payment orders have been frequently issued in Standard Essential Patent（SEP）infringement litigation in India since 2010. These orders allow alleged infringers to continue their infringement activities by depositing a certain amount corresponding to the value of the royalty payment with the courts or patent holders. Most of these orders are issued after a court assessment of the three essential elements in awarding interim injunctions. In 2023, the Delhi High Court held that this Court has the power, if the facts so warrant, to pass a pro-tem order as a temporary arrangement without a detailed exploration of the merits. In this paper, the legal requirements and the deposit amount, which is below the FRAND rate, are discussed through four SEP cases in which pro-tem orders have been issued since 2023. In addition, the impact of pro-tem orders on the Indian remedy system in SEP cases is discussed.
